1. Not a Registered Investment Advisor; no advisory relationship
Trade Tracer is not a "Registered Investment Advisor" within the meaning of the Investment Advisers Act of 1940 or any state investment-adviser act. Trade Tracer is not registered with the U.S. Securities and Exchange Commission, the Financial Industry Regulatory Authority, the Commodity Futures Trading Commission, the National Futures Association, or any state securities regulator. Trade Tracer is not a broker-dealer, futures commission merchant, commodity pool operator, commodity trading advisor, swap dealer, financial planner, accountant, tax advisor, or legal advisor.
All Content published on the Service is general-purpose impersonal educational and informational commentary on publicly available securities and options data. It is made available on the same terms to every subscriber, is not based on any User's specific financial situation, goals, risk tolerance, tax position, holdings, or other individual circumstances, and is not a recommendation tailored to any individual. No fiduciary, advisory, broker, agency, or other professional relationship is created between you and Trade Tracer by your use of the Service.
2. Nothing on the Service is investment advice
The signals, levels (including The Tracer Line and The Anchor Line), scanner output, AI-generated reports, market regime classifications, breadth indicators, charts, educational materials, and any other Content on the Service are not:
- Recommendations to buy, sell, hold, or refrain from buying, selling, or holding any security, derivative, commodity, currency, digital asset, or other financial instrument;
- Solicitations to enter into any transaction;
- Personalized advice for your specific financial situation, goals, risk tolerance, tax position, holdings, or other individual circumstances;
- Guarantees, warranties, or predictions of future performance;
- An offering of any investment product or service;
- A solicitation of an offer to buy or sell any security.
Trade Tracer publishes the same Content to every subscriber. We do not know your circumstances. We cannot give you personalized advice even if we wanted to.
3. Past performance does not predict future results
Historical performance, prior signal accuracy, sample reports, and any past examples of The Tracer Line, The Anchor Line, or other signals are not indicative of future results. Markets change. Strategies that worked in past regimes may fail in future regimes. Past returns do not guarantee future returns.
4. Hypothetical and backtested results carry inherent limitations
Hypothetical, simulated, or backtested performance results have many inherent limitations. Unlike actual performance records, hypothetical results do not reflect actual trading and may not have been impacted by the financial-risk factors of real trading. Among other things, hypothetical results may not account for slippage, liquidity constraints, market impact, commissions, financing costs, taxes, or the discipline required to follow a strategy in the face of trading drawdowns. The benefit of hindsight allows hypothetical results to be constructed with a known outcome that real-time trading cannot match. No representation is made that any account will or is likely to achieve profits or losses similar to any hypothetical results published on the Service.
5. Market and investment risks
All trading and investing involves substantial risk of loss and is not suitable for every investor. The value of investments fluctuates. You can lose money, including more than you initially invested in some circumstances (especially with leveraged products such as margin accounts, futures, and options). Specific risks include without limitation:
- Market risk: losses due to changes in market prices.
- Liquidity risk: inability to enter or exit positions at expected prices.
- Volatility risk: rapid or unexpected price movements that produce large gains or losses.
- Gap risk and slippage: price moves between bars or quotes that prevent execution at expected levels.
- Counterparty risk: failure of a broker, clearing firm, or other counterparty.
- Execution risk: delays or errors in order routing.
- Regulatory risk: changes in law, regulation, or exchange rules.
- Concentration risk: loss amplified by holding too few positions or too much in a single sector.
- Interest-rate risk: changes in rates affecting valuations.
- Geopolitical risk: loss from events including war, sanctions, civil unrest, pandemic, or natural disaster.
6. Options-specific risks
The Service derives several of its signals from the options market. Options trading carries unique and substantial risks:
- Options have a finite life and can expire worthless. Buyers of options can lose 100% of the premium paid.
- Sellers of uncovered options can face theoretically unlimited losses on calls and substantial losses on puts.
- Implied volatility, time decay, dividends, and interest rates affect option pricing in ways that may be counterintuitive.
- Liquidity in some options contracts is limited; bid-ask spreads can be wide and execution may be delayed or denied.
- Multi-leg options strategies have complex risk profiles, including the risk of one leg being assigned, exercised, or closed at a disadvantageous time relative to other legs.
- Early assignment of American-style options can occur at any time before expiration.
- Pin risk near expiration can produce unintended exposure when options finish at or near the strike price.
Before trading options, obtain and carefully read the Options Clearing Corporation publication Characteristics and Risks of Standardized Options (available at theocc.com or from any U.S. broker authorized to trade options). Options trading is not appropriate for every investor.
7. The Tracer Line, the Anchor Line, and other signals are not predictions
The Tracer Line is a regime classifier derived from publicly available options data. The Anchor Line marks the strike with the heaviest dealer gamma positioning. Both are frameworks for thinking about market structure — they are not buy or sell signals, not price targets, not stop-loss levels, and not guarantees of any outcome. Price routinely behaves in ways inconsistent with what these levels might suggest. Trade Tracer makes no representation that price will respect the Tracer Line, the Anchor Line, or any other published level.
8. Data accuracy is not guaranteed
Market data, options data, scanner output, AI-generated reports, and other Content may be inaccurate, delayed, incomplete, or unavailable. Data providers (including Polygon.io) may experience outages, bugs, corrections, or interpretive ambiguity. Our compute pipelines may have errors. Cross-check any Content with your broker, your exchange, and other reputable sources before acting on it.
9. AI outputs are not advice, recommendations, or predictions
Reports, summaries, regime reads, and explanatory text generated by the Service's artificial-intelligence engine are produced by large language models from data we provide. These outputs may contain factual errors, internally inconsistent statements, outdated information, or fabricated content ("hallucinations"). AI outputs are not investment advice, are not recommendations to buy, sell, or hold any security, are not predictions of future price movement, and are not personalized to your circumstances. They are general-purpose educational commentary. Any descriptive language the AI uses about a ticker, regime, or setup — including words like "looks favorable," "supportive," "stretched," "set up," or similar — is descriptive only and is not a recommendation. You should not rely on any AI output without independent verification from your own research and licensed professionals.
10. Founder and personnel trading; conflicts of interest
Disclosure of material conflict. Trade Tracer's founder, employees, contractors, and other personnel (collectively, "Personnel") may from time to time hold long or short positions in the same securities, options, derivatives, or other instruments that appear in scanner output, AI-generated reports, the Pulse, Founder Picks, the Tracer Line, the Anchor Line, or other Content published by the Service. Personnel may enter or exit such positions before, during, or after the publication of Content referencing the same instruments.
Anti-front-running commitment. Personnel do not trade ahead of subscribers based on non-public knowledge of Service Content. Featured setups, Founder Picks, the daily scanner output, and other published Content are released to all subscribers at the same time. Personnel do not establish or adjust positions on the basis of pre-publication access to Service Content with the intent of front-running subscribers.
Independent decisions. Where Personnel hold a position in a security or instrument that also appears in Service Content, the Personnel's trading decisions are made independently from the Service's mechanical scanner output and AI-generated reports. Personnel may decline to act on Service Content, may exit positions before subscribers do, and may take views opposite to those reflected in Service Content. Personnel's individual results are not representative of any subscriber's experience.
No co-investment, no signal-following service. Trade Tracer does not pool subscriber funds, does not manage subscriber accounts, does not place trades on subscriber accounts, does not offer a "copy-trade" or "signal-following" service, and does not represent that Personnel positions or trading results forecast subscriber outcomes.
11. Testimonials, endorsements, and performance claims
Use of testimonials. Where Trade Tracer publishes testimonials, endorsements, reviews, or other social proof on the Service, in advertising, or in any marketing material, each such item is presented with the following understanding, which the reader should attribute to every individual statement of opinion or experience:
- The statement reflects the individual experience of one person and is not representative of the experience of any other subscriber.
- Individual results vary substantially and many subscribers will not achieve similar results.
- Past performance, individual or aggregate, does not predict future performance.
- Where a testimonial-giver received any compensation, discount, or other consideration for the statement, that fact will be disclosed at the point the testimonial appears.
- Where a testimonial-giver is an employee, contractor, affiliate, or other person with a material connection to Trade Tracer, that fact will be disclosed at the point the testimonial appears.
- Trade Tracer does not cherry-pick testimonials to exclude unfavorable feedback in a manner that creates a misleading overall impression of typical results.
Performance claims. Any quantitative claim about past signal accuracy, hit rate, profit factor, or other performance metric appearing on the Service or in marketing material is subject to the methodology disclosure published in our Disclosures. All quantitative performance figures are historical, are subject to the hypothetical-results limitations described in Section 4, and do not predict future results.
12. You are the sole decision-maker
You are solely and exclusively responsible for:
- The trades you place;
- Your position sizing;
- Your stop losses, take profits, and overall risk management;
- The brokerage, exchange, custodian, and product selection;
- The tax, accounting, and legal consequences of your activity;
- Compliance with all applicable securities laws and the rules of your broker, custodian, and exchange.
You should consult licensed financial, legal, and tax professionals before making any investment decision.
13. No liability for losses
Trade Tracer and its affiliates, officers, directors, employees, contractors, and agents are not liable for any trading or investment losses, missed gains, opportunity costs, or other damages resulting from your use of the Service, your reliance on any signal, level, or report, errors or omissions in data or Content, or Service outages. See Sections 10 and 11 of the Terms of Service for the full disclaimer and liability limitation.
14. By using the Service, you accept these risks
Continued use of the Service constitutes your acknowledgment and acceptance of all risks described in this Risk Disclosure. If you do not accept any of these risks, you must not use the Service.
